Does Touching a Man Break Wudu? No, and Here Is Why
C.J Ahmed-10.04.2023
Touching a a non mahram man or woman with or without lust will not break your wudu because there is no evidence to prove that touching will brek your fast. Touching your private parts with lust to enjoy sexual pleasure while fasting is also not haram and thi is based on the following hadith,
Aisha(rali) narrated,
“He (the Prophet (sal) would have sexual relations when he was fasting, and would place a cloth between him and her, meaning over the private part.”
(Reported by Ahmad and Ibn Khuzaymah in his Saheeh. Its Isnad is Good (Jayyid)
In another hadith,
Aisha (rali) said, “He (the Prophet, Sallallaahu alayhi wa Sallam) used to kiss when fasting, touch when fasting, and was the most in control of his desires” (Sahih Al-Bukhari, Muslim, and others)
. This view is further strengthened with the below narration of Aisha (rali) in response to someone who asked her:
“What is Halaal (permissible) for a man to do with his wife when he is fasting?”
She said, “Everything except intercourse.”
This was reported by ‘Abdir-Razzaaq in his Musannaf (4 / 190 / 8439) with a Saheeh (authentic)
chain of narrators, as al-Hafidh Ibn Hajr mentioned in al-Fath. This narration was also used as a proof by Ibn Hazm regarding this issue. (From the Silsilah).
‘Aisha herself, reported by at-Tahaawee with a Saheeh Isnad that Hakeem bin ‘Iqaal said:
“I asked ‘Aisha, “What is prohibited for me from my wife while I am fasting?” She said, “Her
private part.”
Some try to interpret the word “Mubaasharaah” as kissing but, this is wrong as the prophet(sal) used to kiss when fasting, touch when fasting, and was the most in control of his desires
Reported by al-Bukhari, Muslim, and others.
The real meaning for "Mubaasharah" is having sexual relations.
Ibn Hazm in his Muhalla mentioned an authentic hadith which was declared as Athar Sahih (meaning an authentic hadith from a companion)
“That a man came to Ibn ‘Abbas and said to him, ‘I just got married to my beautiful paternal cousin, and I consummated the marriage in Ramadaan. So is it permissible for me, Bi Abee wa Ummee (I am willing to sacrifice my father and mother, (a common Arab phrase)), to kiss her?’ Ibn ‘Abbas said to him, ‘Can you control yourself?’ He said, ‘Yes.’ He said, ‘Kiss her.’ He said, ‘Bi Abee wa Ummee, can I touch her?’ He said, ‘Can you control yourself?’ He said, ‘Yes.’ He said, ‘Then touch her.’ He said, ‘Can I touch her private part with my hand?’ He said, ‘Can you control yourself?’ He said, ‘Yes.’ He said, ‘Touch it"
Islam is a very easy religion and is is hard to control your sexual desires while fasting and Msulims should be more pragmatic and easygoing when following Islam. Abu Huraira reported: The Prophet, peace and blessings be upon him, said,
“Whoever is kind, affable, and easy-going, Allah will forbid him from entering Hellfire.” (al-Sunan al-Kubrá lil-Bayhaqī 20806-Graded authentic by Sheikh Albani)
Abdullah ibn Mughaffal reported: The Messenger of Allah, peace and blessings be upon him, said, “Verily, Allah is gentle and he loves gentleness. He gives for it what is not given for harshness.”(Abu-Dawud- Grded Sahih by Albani)
Ibn Abbas reported: The Prophet, peace and blessings be upon him, said,
“Teach others, make things easy, and do not make things difficult. When one of you is angry, he should remain silent.” (Musnad Ahmed- Graded Sahih by Ahmed Shakir)
Ibn Mas’ud reported: The Messenger of Allah, peace and blessings be upon him, said,
“Shall I not tell you of one forbidden for Hellfire or Hellfire is forbidden for him? It is everyone accessible, polite, and easy-going.”(Tirmidhi-Graded Sahih by Imam Tirmidhi and Sheikh Albani)
So, you can do anything except doing intercourse (entering of the private parts) and it won’t break the fast. Touching a man or woman will not break your fast.
