Why it is Not Haram to Sit in a Pub

It is not haram to sit in a pub where intoxicants are served. There are hadiths which are quoted by some scholars who argue that even sitting with a person who drinks wine is haram.
Jaabir(rali) narrated,, the Prophet (sal) said: “Whoever believes in Allah and the Last Day, let him not sit at a table where wine is being served.” (Tirmidhi-Graded Hasan Sahih by Albani)
Umar ibn al-Khattaab(rali) narrated, the prophet (sal) said, “Whoever believes in Allaah and the Last Day, let him not sit at a table where wine is being drunk.”(Musnad Ahmad-Graded Sahih by Albani in irwa al Ghaleel)
In hese hadiths, the pophet (sal) does not clearly forbid Muslims from sitting in a table wherewine is served but discourages us from doing so.
Abu Hurayrah (rali)
narrated that the prophet (sal) said,
"Avoid that which I forbid you to do and do that which I command you to do
to the best of your capacity."
(Muslim)
In this hadith the prophet (sal) told us Muslims to avoid what he made haram but in the hadith where the prophet (sal) told “let him not it where win is drunk”.
Abdur Rahman ibn Awf reported: He would patrol the city at night with Umar ibn al-Khattab, may Allah be pleased with him, and on one occasion they were walking when the lamp of a household caught their attention. They approached it until they heard loud voices inside the door. Umar grabbed the hand of Abdur Rahman and he said, “Do you know whose house this is?” He said no. Umar said, “This is the house of Rabi’ah ibn Umayyah ibn Khalaf, and they are inside drinking wine right now! What do you think?” Abdur Rahman said, “Indeed, I think we have done what Allah has prohibited for us. Allah Almighty said, ‘Do not spy,’ (49:12) and we have spied on them.” Umar turned away and he left them alone.(al-Mustadrak 8198-Graded Sahih by Imam Dahabi)
In te above hadith Umar (rali) did not intervene when people were drinking wine.
